Who owns the copyright in the work we produce for a ... - Aspect Legal

Who owns the copyright in the work we produce for a client?

As a designer if you are commissioned to create a work for your client, who owns the copyright in the underlying artwork?? This can become a fundamental issue for designers, and is often misunderstood by clients.? If problems arise it is usually because the issue hasn?t been clearly dealt with in your terms and conditions with your client.? It is imperative, at the very least, to have a written contract that covers the issue of the ownership of copyright.


What is copyright?

Here are some basic and fundamental features about copyright:

  • Copyright is a type of intellectual property that covers certain original creative works
  • Copyright is a bundle of exclusive economic rights such as the right to reproduce the material, perform the material, show or communicate the work to the public etc
  • Copyright is automatic, it doesn?t have to be registered, published, or display a copyright notice on it.? Copyright exists as soon as the work is first put in material form.

The general rule about copyright ownership

The general rule in copyright is that the creator of the work is the first owner of the copyright.? But there are exceptions to this, and it can easily get a bit grey.? If you have not specifically dealt with the issue of copyright ownership in a document with your clients, a court may take the view that due to things done or said along the way, you have assigned the underlying rights to the client. Even if you didn?t mean to!


The problem

The problem is that clients often believe that because they are paying for the work that is being created that they ?own? the work and all of the underlying copyright that goes with it.? The result may well be that your client has far greater rights over your work than you intended.

You may for example be prevented from using the work in your portfolio.

You may even be prevented from using elements of the work in work for future clients.

Your client may decide to take your work and replicate it across other business ventures, or sell it online as a template!

The courts are full of examples of disputes that have occurred due to differing views on who owns the ?copyright? out of work conducted, and what rights the other party has to the use of that work. For example in the case of Concrete Pty Ltd v Parramatta Design & Developments Pty Ltd [2006] HCA 55 an architectural firm was contracted to design plans for a property development. A dispute ensued as to who owned the copyright and what each party was entitled to do with the plans. The High Court finally ruled on what rights each party held, but only after the case had already been through both a trial judge AND a Federal Court judge who both decided the case differently. It goes without saying that this would have been a very expensive and time consuming process for everyone involved, and unfortunately with an outcome that was almost impossible to predict for either parties at the beginning of the process.

So what?s the lesson to be learned from all this?


Agreement. Agreement. Agreement.

You need a written agreement, if you don?t want to leave the question of who owns what in the hands of a court that you can?t necessarily predict. ?Your agreement should cover these issues off in writing so if there is an argument, you have an answer in the document ? rather than leaving the outcome up to chance. The point of a clear agreement with your clients is to protect you and your rights, as well as inform your client so that problems don?t arise.

For example, you may have agreed to allow a client to use an image for a business card.? You should ensure that your client doesn?t get the right to use the work in ways you may not have intended, like selling it as a template to others. You might also want to be clear that any rights your client has to the use of the work doesn?t kick in until they have at least paid you!

A carefully drafted agreement should cover all of these sorts of possibilities, and a lot more.

Digital danger: Is our online activity damaging us?

SMARTPHONES, social networking and the internet are destroying our identities, ruining friendships and driving us all insane. At least, that is whatiDisorder by Larry Rosen and Digital Vertigo by Andrew Keen would have you believe. I'm not so sure.

Rosen, a psychologist at California State University in Dominguez Hills, argues that over-reliance on technology can cause psychological problems, the "iDisorders" of the book's title, but I struggled to find any causal link in chapter after chapter of correlations.

He describes how social networking "over-sharers" show signs of narcissism, constant phone-fiddlers might have OCD and general exposure to technology can cause ADHD. But of course, the disorders existed before these technologies, and Rosen fails to convince that their incidence is on the rise.

Digital Vertigo is equally unconvincing. Keen, whose previous book, The Cult of the Amateur, railed against user-generated content, states that privacy "is being dumped into the dustbin of history", warning that we cannot trust the likes of Facebook, Apple and Google with our precious personal data. It is a viewpoint I am entirely sympathetic with, but Keen's argument, woven between name-dropping anecdotes from Silicon Valley conferences, a potted history of privacy gaffs in 2011 and a liberal sprinkling of oft-repeated quotes from The Social Network, left me siding with the tech giants.

As Keen points out, we must all take personal responsibility for the information we put online. However, social media need not inevitably lead to Truman Show-style dystopia, as he suggests. I have found Twitter, Facebook and other online services essential for initiating and maintaining major social connections. In fact, without social networking, I would be short one wife, one job and at least half a dozen close friends.

These technologies are tools, and like all tools they must be used correctly. Cars are far more dangerous to society than Facebook; according to the World Health Organization, 1.2 million people die in road traffic accidents each year. We as a society accept this because of the benefits that cars offer, and we work to mitigate the downsides. It should be the same with smartphones and social networking. If you can't go five minutes without a status update then, yes, you should probably step away from the touchscreen, but let's not ignore the great opportunities these technologies offer for fear of some unproven and unrealised disaster.

People used to worry about the effects of the telephone on society, but 150 years on, we seem to be managing just fine.

By knocking out this wall in particular, it can create an open concept feel that really changes the dynamic of the space. Raise the Ceilings

Raising the ceilings in a room can also make a big difference as far as how big it feels. Installing an Extension

Installing an extension, such as sunroom - or if you're in the UK, a conservatory -, literally will make your house bigger! Particularly with conservatories, the windows all around the exterior of the room will make it feel very large as well. Getting an extension added on, and then the wall knocked through (so everything is open plan), with large windows can totally transform a home.

At the very least, have a good tidy! RIM's top lawyer joins parade of resignations

TORONTO (Reuters) - The top lawyer at Research In Motion Ltd has resigned and will soon leave the struggling BlackBerry maker, RIM said on Monday, joining a parade of long-time company executives to depart since Thorsten Heins took over as CEO earlier this year.

The loss of Chief Legal Officer Karima Bawa - who litigated numerous patent disputes and helped write many of RIM's commercial deals - follows the resignation of RIM's head of global sales, Patrick Spence, last week.

"Thorsten Heins is reframing the RIM organization. Not everyone will fit into the new picture," said IDC analyst Kevin Restivo. "Departures, forced or otherwise, are inevitable anytime management sets a new course for an organization."

The resignations come ahead of what are expected to be massive layoffs this year as the company prepares to launch BlackBerry smartphones run by an operating system completely different from that used in its legacy phones.

RIM's shares have fallen some 75 percent in the last year while its market share has shriveled against competition from iPhone maker Apple Inc and a slew of manufacturers using Google Inc's Android operating system.

RIM's Toronto-listed rose 0.9 percent to C$11.34 late Monday afternoon. The company's Nasdaq-listed shares were not trading due to a U.S. holiday.

Bawa, who joined RIM in 2000, was promoted to general counsel and chief legal officer in late 2010.

She plans to stay with the company while a replacement is hired and during a transition, RIM said in an emailed statement after Reuters asked about Bawa's status.

Analysts and former employees have long complained about what they viewed as a hyper-cautious corporate approach at RIM. That grew out of a drawn-out patent dispute early in the company's rise and was exacerbated by the hiring of a slew of in-house lawyers afterwards.

CLEANING HOUSE

RIM is quietly cleaning out layers of management and recruiting fresh faces to fill important roles in a new structure being fashioned under Heins, who himself replaced longtime co-CEOs Mike Lazaridis and Jim Balsillie in January.

"Thorsten has a very different leadership style," said one former RIM employee who left several months ago. "He is picking a very specific organizational structure, inner circle, external hires and strategy, and a lot of folks aren't 100 percent comfortable with it."

The former employee spoke on the condition of anonymity to protect his ongoing business relationship with the company.

The Waterloo, Ontario-based company currently employs around 16,500 people globally. Two sources with close connections to RIM have told Reuters that RIM plans to bring its workforce closer to 10,000 by early next year.

The sources asked to go unidentified because their disclosures would hurt their relationships with RIM.

The cuts will affect RIM's legal, marketing, sales, operations, and human resources divisions, one of the sources said.

"The Research In Motion people have come to know is very likely to be a much smaller organization in the near future," said IDC's Restivo. "It's a reflection of the company's smartphone struggles. Call it an trailing indicator if you will."

RIM's share of the global smartphone market slipped to 6.7 percent in the first quarter of 2012 from 13.6 percent a year earlier, according to IDC.

A round of 2,000 job cuts was planned for around June 1, the day before the end of RIM's quarter, the Globe and Mail said on Saturday, citing several people close to the company.

Last July RIM said it cut 2,000 jobs, after its worker count ballooned to near 20,000 following a string of acquisitions in recent years.

Balsillie remains the departure with the highest profile. While cutting all formal ties to the company, he remains a major shareholder. Lazaridis is still influential on the board.

A chief operating officer, Jim Rowan, and the head of software David Yach left in March. Soon after, Alan Brenner, a senior vice president for the BlackBerry platform, and Alistair Mitchell, vice president for the BlackBerry Messenger instant messaging product, also left.

The head of RIM's India unit left in November, its head of government relations left months before that, and former chief marketing officer Keith Pardy departed more than a year ago.

RIM said this month it had replaced Pardy with wireless veteran Frank Boulben, who has yet to start work.

It has also named Kristian Tear as its single chief operating officer. He replaces Heins, who took the CEO job, Rowan, who departed, and a third operating head, Don Morrison, who retired last year.

Beyond SpaceX: Five companies seeking to change space travel

On May 19, SpaceX will attempt to become the first private company to dock a capsule with the space station. Since the space shuttle Columbia disaster in 2003,?Presidents Bush and Obama have directed NASA to turn the job of transporting cargo and crew to the station over to private firms.

NASA already has $3.5 billion in cargo contracts with two rocket makers ? SpaceX and Orbital Sciences Corporation ? and has added $270 million in seed money to four companies to develop technologies to transport crews. This summer, NASA expects to provide additional money to help private space companies develop full-scale systems. Here are the key players:

SpaceX was founded in 2002 by Elon Musk, a co-founder of the online payment service, PayPal. Mr. Musk's team has developed rockets aimed at driving down the cost of launching payloads and people into space.

In 2008, after three failures, the company's two-stage Falcon 1 rocket became the first privately financed rocket to reach orbit. It lofted its first satellite in 2009.

The company's next model, the Falcon 9, is designed to be the workhorse for space-station resupply missions and for launching commercial satellites. As a resupply ship, it's topped by a capsule (called Dragon) designed to carry cargo and ? in the future ? space-station crew members. So far, NASA has spent $75 million on the company's efforts to develop the human-transportation portion of its efforts.

Falcon 9 aced its first test launch in June 2010, topped with a dummy capsule. A second launch six months later put the company into the record books as the first privately financed rocket maker to orbit and recovery a capsule.?

As early as the end of this year, SpaceX plans to test its next rocket, the Falcon Heavy, in a launch from Vandenberg Air Force Base in California. It's designed to loft up to 53 metric tons of cargo to low-Earth orbit, more than twice the capacity of the space shuttle. It would be the most powerful rocket in the US stable since NASA's Saturn V first launched astronauts to the moon's surface in 1969.?

Being a mother, wife, lover, woman, friend? sometimes it?s hard. Maybe it?s just that by definition relationships are hard. Look above. The word connection is used in three of the four explanations of relationship and hey, connection isn?t always easy.

I opened the Bible on a day years ago when life and my relationships were getting the better of me. I was down and looking for some encouragement. I love to open certain books (the Bible being one of my favorites to do this with) to a random page and let where ever my finger falls speak to me. The words on which I land almost always knock me off my feet with the wisdom they hold. A word, passage or an entire page; on this day the message for me was contained in a single word.

This single word spoke volumes to my heart. I was on a family vacation with my husband and four young kids. The saying ?where ever you go, there you are? could not more accurately describe my state of mind. Here I was with the ones I loved on an island off the coast of Georgia, near paradise, and yet my heart was heavy. I remember struggling at the time with balance. Questions about who I was a woman verse who I was as a wife and mother were stirring inside me.

Hmmm. Ephphatha. The morning after finding my word (and still not being exactly sure why) I rose early to take a walk. The word I had unearthed was working on me. What was this word and what key towards balance did it hold for me?

And then there on my walk, I saw it. The answers to my questions.

It was standing there in the form of a great, big, old majestic tree. Beautiful, stretched out in all it?s glory, but so alone.

It was then it hit me. I walked home, grabbed a piece of scrap paper and wrote down this poem.

A solitary oak left to grow alone.

Beautiful, symmetrical and glorious to behold, standing strong

in stark contrast to the wide open field around it,

where sunlight and water abound for it?s pleasures alone.

Obama sketches four-pronged strategy for Europe, sees EU consensus

CHICAGO (Reuters) - U.S. President Barack Obama urged Europe on Monday to strengthen its defenses against financial market turmoil and recapitalize its banks as part of a four-pronged strategy for tackling the euro zone crisis.

European leaders have shown an increased resolve to address these issues, and there is a "consensus across the board" from France, Germany and other European countries, Obama said in remarks that suggest Europe is considering broadening its approach to resolving the euro zone's sovereign debt crisis.

"I do sense greater urgency now than perhaps existed two years ago or two and a half years ago," Obama said at a news conference to wrap up four days of G8/NATO meetings.

World leaders are growing increasingly alarmed that the budget austerity approach favored by Germany threatens to drive Greece from the euro zone and deepen Spain's bank problems, which could trigger a global financial crisis and tip the world back into recession.

For Obama, that could cost him re-election in November.

Obama was joined by British and French officials over the weekend in calling for bolder action ahead of a crucial meeting of European Union leaders on Wednesday first called to discuss adding a growth plank to their fiscal strategy.

Obama's remarks point to a four-pronged approach that would encompass financial, economic, fiscal and monetary measures to address the euro zone crisis that he said were embraced by leaders who attended a G8 summit in Maryland and the NATO sessions in his home town of Chicago.

"We've got to put in place firewalls that ensure that countries outside of Greece that are doing the right thing aren't harmed just because markets are skittish and nervous," Obama said.

"We've got to make sure that banks are recapitalized in Europe so that investors have confidence. And we've got to make sure that there is a growth strategy to go alongside the need for fiscal discipline, as well as a monetary policy that is promoting the capacity of countries like a Spain or an Italy to put in place very tough targets and some very tough policies," Obama said.

These measures would offer the people in the affected countries the prospect for economic growth, jobs and growing incomes, he said.

'WE STILL HAVEN'T DONE ENOUGH'

British Prime Minister David Cameron sent a similarly urgent plea to European leaders for firm action, noting that 40 percent of British exports go to the euro zone.

"The truth is we still haven't done enough to decisively resolve the crisis," Cameron told a news conference during a NATO summit. He also said that bank recapitalization, firewalls and a more active policy from the European Central Bank were needed, as well future plans for a common euro zone bond.

International bankers also are pressing European leaders in private meetings for quick action.

The Institute of International Finance (IIF), a global association of financial institutions, estimates total credit exposure to Greece at $460 billion of which $70 billion is to private sector investors, mostly in Germany and France. The private sector exposure to Spain is much larger.

"There has to be concrete progress to stabilize market conditions," said Hung Tran, IIF deputy managing director.

At the least, the IIF said it would like to see direct injection of EU bailout funds into under-capitalized banks - an issue that could be discussed at the EU dinner this week.

Germany has resisted the idea, partly because it would require new rules for its bailout monies and make bank risk an EU responsibility while regulation remains primarily at the national level. But France and Italy are advocates.

Another issue that needs addressing is bank deposit insurance, Tran said. One proposal is for the EU to offer an umbrella backup to national deposit insurance schemes. This could prevent a bank run if a sovereign government runs into financing problems. But he said recapitalization is a priority.

Spain reported last week that bad loans in its banks have risen to their highest in 18 years, underscoring problems the government faces as independent auditors begin looking at the depth of the problem in its banking sector. The size of bad loans has raised questions over how Spain could afford to help recapitalize its banks.

French President Francois Hollande has said he will push a proposal for mutualizing European debt at the informal summit of EU leaders in Brussels this week. This would be one way to help out deeply indebted countries like Spain, Italy and Greece. But it increases pressure on German Chancellor Angela Merkel to drop her opposition to the idea.

Pancreatic cancer may be detected with simple intestinal probe

ScienceDaily (May 21, 2012) ? By simply shining a tiny light within the small intestine, close to that organ's junction with the pancreas, physicians at Mayo Clinic's campus in Florida have been able to detect pancreatic cancer 100 percent of the time in a small study. The light, attached to a probe, measures changes in cells and blood vessels in the small intestine produced by a growing cancer in the adjoining pancreas.

This minimally invasive technique, called Polarization Gating Spectroscopy, will now be tested in a much larger international clinical trial led by the Mayo Clinic researchers. The preliminary study suggests it may be possible, one day, to use a less invasive endoscope to screen patients for early development of pancreatic cancer.

The findings are being highlighted in a special address by Mayo Clinic gastroenterologist Michael Wallace, M.D., at the international Digestive Disease Week 2012.

The pancreas is notoriously hard to reach and see due to its very deep location in the abdomen, surrounded by intestines. The study investigators theorized that there may be changes in the nearby "normal appearing" tissue of the small intestine which is much more accessible.

"No one ever thought you could detect pancreatic cancer in an area that is somewhat remote from the pancreas, but this study suggests it may be possible," says Dr. Wallace, the chairman of the Division of Gastroenterology at Mayo Clinic in Florida. "Although results are still preliminary, the concept of detection field effects of nearby cancers holds great promise for possible early detection of pancreatic cancer."

Pancreatic cancer is one of the most deadly of human tumors. It is only curable in 5 percent of cases, and even when it is surgically removed, 70 percent of patients have a recurrence that is fatal, Dr. Wallace says. There are no ways currently to detect the cancer early enough to cure a substantial number of patients, he says.

Pancreatic cancer is now usually detected through an imaging scan, followed by an invasive biopsy. Tumors found in this way are usually at an advanced stage.

In this study, the Mayo Clinic physicians tested a light probe developed by their long-time collaborators at Northwestern University.

The light, attached to a small fiber-optic probe known as an endoscope, measures the amount of oxygenated blood as well as the size of blood vessels in tissue near the duct where the pancreas joins the small intestine. Because a growing tumor requires a heightened supply of blood, normal tissue in the vicinity of the cancer reveals evidence of enlarged blood vessels and changes in the amount of oxygen within the blood.

Such "field effects" from cancer can be measured in other areas of the GI tract, says Dr. Wallace. "With this technology, others studies have shown that cancerous polyps can be detected more than 11 inches from the polyp itself. Early studies are evaluating if esophageal cancers can also be detected remotely," he says.

The probe acts "a bit like a metal detector that beeps faster and louder as you get close to cancer," he says. The researchers are measuring within six to 10 inches of the pancreas in the small intestine immediately next to the pancreas.

Dr. Wallace and his team tested the probe on 10 patients who were later determined to have pancreatic cancer, and on nine participants who did not have pancreatic cancer.

They found that testing both measures -- blood vessel diameter and blood oxygenation -- detected all 10 pancreatic cancers. But the probe was less precise (63 percent accurate) in determining which of the healthy volunteers did not have pancreatic cancer.

"There is room for improvement in this instrument, and our group is working on that," he says. "If the studies confirm the early results, it would make the pancreas accessible to a much simpler upper endoscope and that would be a real advance in the treatment of pancreatic cancer."

Patients now often undergo an endoscopic examination of the upper intestine to search for the cause of heartburn or stomach pain, Dr. Wallace says. An endoscopic probe could be easily outfitted to explore for evidence of pancreatic cancer in patients at heightened risk, he says.

Mihir Patel, M.D., a gastroenterologist who worked with Dr. Wallace on the study, says that despite of intense research, we haven't been successful in significantly improving the overall survival associated with pancreatic cancer in the past several decades. That's because we haven't been able to detect the cancer early enough. Developing a technique to screen the patients and detect pancreatic cancer at an early stage would be a potential breakthrough. In our preliminary data, this technology has shown to hold similar potential.

The study's co-authors include Vadim Backman, Ph.D., a professor in the biomedical engineering department at Northwestern University and Hemant Roy, M.D., a gastroenterologist at Northwestern University.

The study was funded by the National Institutes of Health and Mayo Clinic.

Nationalist wins Serb presidential runoff

BELGRADE, Serbia (AP) ? Nationalist candidate Tomislav Nikolic won the Serbian presidency on Sunday, a result that adds to the political turmoil in the Balkan country and could slow down its attempts to join the European Union.

The Center for Free Elections and Democracy, an independent polling group, said Nikolic won 49.4 percent of the vote, while pro-European Union incumbent Boris Tadic received 47.4 percent. Tadic conceded defeat, saying, "I wish Nikolic the best of luck." The results are expected to be officially confirmed by Monday.

The outcome was a sign of the fading allure of the EU, which is plagued by a debt crisis, and voter discontent with Serbia's weak economy.

Nikolic must name a prime minister, but that task has been complicated because of the outcome of the May 6 parliamentary election. Although Nikolic's Progressive Party won the most seats, Tadic's Democrats have tentatively agreed on an alliance with Socialists that would give them a majority. Nikolic has claimed the May 6 vote was marred by fraud.

"We'll see what will happen," Nikolic said as his supporters chanted his nickname, "Tomo the Serb," on the main squares in Serbian cities.

The outcome also could hugely impact Serbia's plans to become an EU member, a major step for a country that was a pariah state under late autocrat Slobodan Milosevic in the 1990s. It also could determine whether Serbia continues to reconcile with its neighbors and wartime foes, including the former province of Kosovo, which declared independence in 2008. Serbia has refused to recognize Kosovo's independence.

Nikolic, who narrowly lost two earlier presidential votes to Tadic, claimed to have shifted from being staunchly anti-Western to pro-EU. But that change is widely believed to be a ploy to gain more votes. Nikolic has close ties with Russia and has in the past even envisaged Serbia as a Russian province.

"Serbia will not stray from its European road," Nikolic, a former ultranationalist ally of wartime Serbian leader Milosevic, insisted Sunday. "This day is a crossroad for Serbia."

He added that Serbia must "get rid" of poverty and corruption.

Tadic, who championed Serbia's bid to become an EU member, was leading the pre-runoff polls, but Nikolic's nationalist supporters appeared to have more enthusiasm for casting their ballots. Election observers said turnout was about 10 percent lower than in 2008, when Tadic beat Nikolic by a slight margin.

Tadic built his presidential bid around pro-Western policies, but his biggest problem was the economic downturn and corruption within the ruling elite. Faced with the financial crisis in Europe and beyond, which slowed down much-needed foreign investment, Tadic's government has seen massive job losses and plummeting living standards.

Nikolic's populism struck a chord with voters, who warmed to his criticism of widespread social injustice and corruption in Serbia and promises of jobs, financial security and billions of dollars in foreign investment.

Tadic took a more conciliatory stance toward Serbia's neighbors and war foes in the 1990s, including Kosovo, the former province that nationalists consider the cradle of Serbia's state and religion. Nikolic has said he would abandon the EU plan if it means that Serbia must give up the claim to Kosovo, and he has forged an alliance with the staunchly anti-EU party of former premier Vojislav Kostunica.

7 charged with terror crimes in Real IRA crackdown

(AP) ? Seven Irish republicans, including three relatives of a senior reputed Real IRA member and four others allegedly operating a forest rifle range, were arraigned Saturday on terror charges following a security sweep against militants plotting to sabotage Northern Ireland's peace process.

Three relatives of Colin Duffy, a reputed senior Real IRA figure, appeared in a courtroom southwest of Belfast surrounded by police officers in full riot gear. None offered pleas and all were ordered held without bail until their next court appearance June 8.

Duffy's brothers, Paul, 47, and Damien, 42, and cousin Shane Duffy, 41, all were charged with four counts of preparing acts of terrorism, conspiring to murder and conspiring to cause explosions. Paul Duffy also was charged with directing terrorism.

Colin Duffy, who wasn't charged as part of the latest sweep, was acquitted in January of murdering two off-duty British soldiers. He joined relatives and friends in the courtroom's public gallery and cheered supportively as the three men were led away in handcuffs.

And in Omagh, the Northern Ireland town where the Real IRA committed the single deadliest bombing of the entire four-decade conflict, a woman and three men were arraigned on charges of preparing acts of terrorism, possessing a rifle and ammunition, and attending a Real IRA training camp in secluded woods near Omagh.

Two of those charged, 37-year-old Sharon Rafferty and 46-year-old Sean Kelly, also were charged with directing terror. All four were ordered held without bail until their next court date Tuesday.

The Real IRA killed 29 people, mostly women and children, in an Aug. 15, 1998, car-bomb attack on the center of Omagh. The group laid low for nearly a decade but in 2007 resumed attacks, chiefly against police and their civilian supporters.

Policemen testified that they had audio recordings of Rafferty and Kelly discussing how to target police officers, acquiring guns, running firearms training and financing Real IRA operations. Kelly is a former convicted member of the Provisional IRA, the dominant faction that renounced violence and disarmed in 2005.

All four allegedly were seen leaving a Real IRA firearms-training session in March, and police said they recovered both DNA evidence and about 200 casings of spent bullets from the scene. Police said they had found a rifle, terrorist-style masks, rubber gloves and four sets of waterproof clothing at the home of another man facing charges, Gavin Coney.

Northern Ireland authorities created the offense of "directing terror" in 1994 as a way to convict previously untouchable commanders of paramilitary groups, who typically didn't directly participate in attacks, but the new charge has been applied only once before: to convict Johnny "Mad Dog" Adair, a notorious Belfast militant from the British Protestant side of the community, in 1995. Adair had been tape-recorded bragging to undercover policemen about his murderous exploits against the IRA's host Catholic community.

Authorities in the neighboring Republic of Ireland also introduced the "directing terror" charge in 1998 following the Omagh bomb atrocity, but it too has been used just once: to convict the founder and original senior commander of the Real IRA, Michael McKevitt. Proving that case required use of an American double agent recruited by the FBI and MI5 to befriend McKevitt.

Police braced for potential trouble Saturday in the Duffys' power base of Lurgan, a religiously polarized town southwest of Belfast. Typically Real IRA members and supporters have mounted car hijackings and bomb threats whenever Colin Duffy or his relatives have faced legal action.

In the first sign of such trouble within an hour of the Duffys' court appearance, police said they discovered a possible bomb at a roadside in the Belfast suburb of Dunmurry, evacuated several nearby homes, and deployed British Army bomb engineers to the scene.
